These Terms of Use govern your access to and use of the UpskAill website, services, and course offerings, operated by eAirth Training & Consulting LLP ("UpskAill", "we", "our", or "us"). By using our services, you agree to be bound by these terms. If you do not agree with any part of these terms, please do not access or use our services.
1. Course Delivery
All public courses offered through UpskAill are delivered live via Zoom. UpskAill reserves the right to use alternate platforms (such as Microsoft Teams or Google Meet) for custom training sessions based on client preference. We may also offer onsite custom training where appropriate and feasible.
2. Account Creation and Access
User accounts are automatically created upon successful course purchase. Login credentials will be emailed to the user. You are responsible for maintaining the confidentiality of your account information and for all activities conducted under your account.
3. Access to Class Recordings and Materials
Upon completion of a live course, users are granted perpetual access to class recordings and relevant materials via their UpskAill account. These materials are accessible only through the user dashboard and are not available for download or external sharing.
4. Prohibited Uses
Users may not:
- Share, distribute, or publish course content
- Download or screen record class recordings
- Resell access to any content or services
- Impersonate another user or entity
- Attempt to hack, disrupt, or misuse the website
5. Refunds and Course Transfers
UpskAill offers a 2-day refund policy from the date of course purchase. After the refund window, users may:
- Reschedule to a different date of the same course
- Switch to a different course
- Transfer their seat to a colleague

6. Intellectual Property
All course content, materials, logos, designs, and videos are the intellectual property of UpskAill and may not be copied, reproduced, or used without express written permission.
7. Limitation of Liability
UpskAill shall not be held liable for any direct or indirect damages arising from the use of its services, including but not limited to loss of data, profit, or training outcomes. Users participate in training sessions and apply the learnings at their own discretion.
8. Modifications to Terms
We may update these Terms of Use at any time. Continued use of UpskAill services following any changes constitutes your acceptance of those changes.
9. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of India. Any disputes shall be resolved by arbitration in accordance with the Indian Arbitration and Conciliation Act, 1996, with the seat of arbitration in Ahmedabad, India.
10. Dispute Resolution for International Users
While arbitration shall be held in Ahmedabad, India, international users agree to first attempt to resolve any disputes with UpskAill through good-faith negotiations. If unresolved, international arbitration procedures will be subject to mutually agreed terms in accordance with international commercial dispute resolution standards.
11. Use of Third-Party Services
We may use third-party platforms and services such as Zoom, Google Meet, PayPal, Razorpay, and email marketing tools to deliver our services. By using UpskAill, you also agree to the terms of these third-party providers. UpskAill is not responsible for the availability or accuracy of third-party systems.
